Terms of Use
Version of 2026-10-12 · «Smakora» app, build 0.3.0
1. General
These Terms govern the use of the «Smakora» app (the App) — a service with a free tier and paid subscriptions, provided by ФОП Яковенко Дмитро Олександрович (the Administrator). Full seller details are on the Seller details page.
By registering an account, signing in, or continuing to use the App, you confirm that you have read, understood and accept these Terms and the Disclaimer, which forms an integral part of them. If you disagree with any provision, do not use the App.
2. Who may use the App
- Registration is open: an account is created with an email address confirmed by a code, or via Google or Apple sign-in. In the form, consent to these Terms is given by a checkbox; with Google or Apple sign-in, by the notice under the buttons themselves.
- The App is intended for people aged 16 and over. Below that age, use is only permitted under the supervision and with the consent of a parent or guardian.
- One account — one person. Mass account creation (including to bypass limits) is prohibited.
- The Administrator may refuse access or block an account — giving the reasons, except where the law forbids disclosing them. You can appeal the decision by writing to [email protected]; we reply within 7 days.
3. Account and security
- You are responsible for keeping your password safe and for everything done under your account.
- We recommend turning on email sign-in confirmation in the «Security» section, and better still adding a passkey: it, rather than a code by email, is a genuine second factor.
- The App keeps a login log (time, country, browser and system family; the IP address is not stored), visible to you in your account and to the Administrator. This exists for account security.
- Report any suspected unauthorised access to the Administrator as soon as possible.
4. Your content
- Recipes, photos, product names, comments and other material you add remain yours. You are responsible for their legality, accuracy, and for holding the rights to publish them.
- By adding content you grant the Administrator a non-exclusive, royalty-free right to store, process and display it as needed to operate the App (including to members of your groups and via public links you create).
- Import from links, video, photos and text. The import feature brings a recipe (including its photo) into your collection for personal, non-commercial keeping. By importing a source you confirm that you have the right to use it that way: it is lawfully available to you, and keeping a copy for yourself infringes neither the author's copyright or neighbouring rights, nor the platform's rights, nor anyone else's. You are responsible for the imported content — both for where it came from and for what you do with it next. The Administrator does not vet import sources in advance, is not their author, and does not become the rights holder of the material you bring in.
- Attribution and publishing imported recipes. Your copy keeps a link to the source, and where we could read them, the author's name and the original title: that is a credit line under a copy, not authorship on your part. You may make an imported recipe public, or create a share link for it (§5), only if you have the right to do so: personal access to the source is not enough to publish it. A rights holder — the author, the platform or anyone else whose rights are affected — may request removal under §16, and we take the content down on a substantiated complaint.
- You must not upload: content you have no rights to; sexual, violent, discriminatory or otherwise unlawful material; other people's personal data without their consent; recipes that knowingly endanger health or life; malicious code.
- Photos go through an automated (AI) check. A rejected photo blocks further photo uploads until an Administrator unblocks you. This check is not a guarantee — it may wrongly reject acceptable photos and may let unacceptable ones through. Rejected photos are reviewed by the Administrator in the admin panel, not in third-party messengers.
5. Visibility and public links
A recipe can be private, group-only or public. Separately, there are public share
links (/s/…): anyone holding such a link can see the recipe
regardless of its visibility setting and without signing in. This is
intentional. By creating and distributing such a link you accept that you lose control over
how far the recipe spreads.
6. Groups and shared access
Members of your group can see and edit shared recipes, pantry, shopping lists and meal plans. When you add someone to a group, you accept the scope of access you are granting. The Administrator does not intervene in relationships inside groups.
7. AI features
The App uses AI models from a single provider, Google Gemini (there are no other AI services in the App) to generate recipes, extract recipes from text or screenshots, suggest weekly meal plans, and moderate photos. The terms, limits and liability disclaimers for these features are set out separately in the Disclaimer. By using AI features you separately confirm you have read it.
Data you submit to AI features (prompt text, images) is sent to the model provider for processing. Do not enter confidential information there.
Every AI request costs money, so their number is capped: there are rate limits (requests per hour), daily caps on individual actions, and a monthly spending cap per account. When a cap is reached the feature temporarily returns a refusal — this is not a malfunction. Circumventing these limits (including via multiple accounts) is prohibited by §2.
8. Nutritionists and other users
- The App lets you assign another user as a «nutritionist» for yourself or your group. Once assigned, they can see your nutrition data (birth year, gender, weight, dietary preferences, allergies) and can build meal plans for you.
- Such users are independent third parties. The Administrator does not verify their qualifications, education, licences or good faith, and is not responsible for their advice. The App is merely a technical tool for exchanging information.
- Assigning a nutritionist is your own informed decision to share health-related data. You can revoke it at any time.
- Any communication, arrangements or payment between you and such a user happen outside the App and do not concern the Administrator.
9. Health data
The «birth year», «gender», «weight», «dietary preferences» and «allergies» fields are filled in entirely at your discretion. They are used to adjust recipe sorting, show allergen warnings, inform AI meal-plan suggestions, and are visible to nutritionists you have assigned. This is a special category of data, so it is processed on the basis of a separate consent given in your settings, which you can withdraw in the same place along with clearing the fields. Do not fill them in if you do not want this information stored. More in the Privacy Policy.
10. Subscriptions, payment and refunds
Some features (AI menus, receipt scanning, ingredient swaps, the AI nutritionist) are available only with a paid subscription. Creating recipes with AI is available without one too — within the free new recipes per week (from links, videos, photos or a description), which reset every week; creating recipes by hand is not limited. A subscription may also be granted by the Administrator or by promo code; there is no trial period.
Prices shown on the plan page are final: all taxes and mandatory charges are included. Before you confirm a payment we show the plan, the amount and the period being charged for.
10.1. Three sales channels
- On the website — monobank acquiring. The seller of record is the Administrator (ФОП Яковенко Дмитро Олександрович; details on the Seller details page).
- In the App Store app — Apple is the seller of record. The purchase contract is concluded with Apple under its terms; we only receive confirmation of the subscription status from it.
- In the Google Play app — Google is the seller of record, on the same basis.
10.2. Auto-renewal and cancellation
A subscription renews automatically: at the end of the paid period the next payment is charged at the tariff in force at that time. You can cancel auto-renewal at any time — access then runs to the end of the period already paid for:
- website — «Plan and payment» → «Cancel auto-renewal»; the card is unlinked;
- App Store — Settings → your name → Subscriptions;
- Google Play — Play Store → Subscriptions.
If a charge fails (insufficient funds, expired card) we retry over the next few days. After several consecutive failures auto-renewal stops, and access runs to the end of the paid period.
Limits are counted from the day the subscription was taken out, not from the first day of the month: for someone who subscribed on the 20th, the billing month runs from the 20th to the 19th.
10.3. Right of withdrawal for consumers in the EU/EEA
If you are a consumer in an EU or EEA country, you may withdraw from the contract within 14 days of payment, without giving any reason (Directive 2011/83/EU). An unambiguous statement by email to [email protected] or via the feedback form is enough — no special form is required. We refund by the same means you paid, within 14 days of receiving your statement.
Using the subscription does not take this right away. A subscription is a digital service that starts being supplied immediately after payment, and at checkout you expressly ask for supply to begin at once and acknowledge that, if you withdraw, you will pay an amount proportionate to what has already been supplied (Article 14(3) of Directive 2011/83/EU). Using the service changes only the sum refunded, not the right itself.
How much comes back. Deducted from the refund is the cost of the AI features actually used during the paid period: those calls were paid to the model provider at call time. It is metered in US dollars and converted to hryvnia at our internal rate — both the amount and the rate are shown with your refund request. The payment provider's fee is not withheld from an EU/EEA buyer. If you have not used the AI features, the whole sum you paid comes back. If the cost of the AI requests used exceeds the amount paid, no refund is made.
10.4. Refunds outside the EU/EEA
Within 7 days of payment you may submit a refund request under «Plan and payment». The request is reviewed by the Administrator. Withheld from the amount are: the payment provider's fee (10%), which it does not return, and the cost of AI requests already used — these were paid to the model provider at call time and are not refundable. If the cost of the requests used exceeds the amount paid, no refund is made. After 7 days the paid period is non-refundable. This is goodwill on our part, not a statutory requirement, and it does not narrow any mandatory consumer rights under the law of your country of residence.
10.5. Store purchases are refunded by the store
A subscription bought in the App Store or Google Play cannot technically be refunded by us — the store received the money. Contact them directly: reportaproblem.apple.com for Apple; Play Store → «Order history» → «Report a problem» for Google. All refund terms are summarised on the Refunds page.
10.6. Donations and changes to terms
A donation («Support the project») is a voluntary one-off payment of any amount. It is not a payment for services, grants no paid features and raises no limits; it only earns a badge on your profile. Donations are not refunded, and no card is stored for them.
Limits apply to AI request frequency and photo uploads. They exist to contain third-party service costs and may change. Any change to the price or limits of an active subscription is announced in advance; disagreeing with the new terms means cancelling auto-renewal.
11. Third-party services
The App relies on: Hetzner (server and database hosting, Germany, EU), Google (OAuth sign-in and Google Identity Services), Google Gemini (AI), Cloudflare (proxy, image storage, bot protection), Resend (verification emails), Apple (sign-in and APNs for notifications), your browser's web-push service, the App Store and Google Play (as payment channels), monobank (acquiring), Open Food Facts, USDA and Zakaz (product reference data), Silpo (only if you connect your own store account), the YouTube and Vimeo players (loaded only after you click), GitHub (handling your bug reports — the text and screenshot end up in the project's private issue tracker), Telegram (service alerts to the Administrator) and a Home Assistant webhook if you configured one yourself. What each of them receives is set out in §4 of the Privacy Policy. These services operate under their own terms and policies; the Administrator does not control them and is not responsible for them.
12. Moderation
Any user can report a recipe. A report hides the recipe from your feed and is sent to the Administrator or a moderator, who may hide or delete the content and block the account. The decision is communicated to the author with its reasons — except where the law forbids disclosing them. You can appeal by writing to [email protected]: we review the appeal on its merits and reply within 7 days.
13. Service availability
The App is provided «as is» and «as available», without warranties of uptime, absence of errors or fitness for a particular purpose — to the extent permitted by law and without prejudice to your mandatory consumer rights (§14). The service runs on privately owned hardware: outages and the change or discontinuation of an individual feature are possible. Do not rely on the App as the only store of important data — keep your own backups.
14. Limitation of liability
To the maximum extent permitted by law, the Administrator is not liable for indirect damage, including but not limited to: consequences of following a diet or meal plan, loss or corruption of data, lost profit, the actions of other users (including nutritionists), AI errors, or third-party service failures.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including liability for intent, gross negligence, or injury to life or health), and nothing affects mandatory consumer rights you hold under the law of your country of residence. Some jurisdictions do not allow certain warranty or liability exclusions; in those jurisdictions the exclusions apply only to the extent permitted.
If, notwithstanding the above, the Administrator is nevertheless found liable, that liability is in any case limited to the amount you paid for the App during the 12 months preceding the event that caused the damage. For someone on the free tier who has paid nothing, it is limited to the reasonable minimum permitted by applicable law.
You agree to indemnify the Administrator for losses arising from your breach of these Terms or of third-party rights.
15. Personal data
The controller of your personal data is the Administrator. The App processes: your email address and profile data; content you add; the login log (time, country, browser and system family — no IP address); and technical data needed to run the service. Legal bases: performance of these Terms (providing the service), legitimate interest (account and service security), and your consent — for optional fields.
- Health-related data (weight, allergies, dietary preferences, etc. — see §9) belongs to special categories of data. It is processed on the basis of a separate explicit consent that you give in your settings and can withdraw in the same place.
- Data is shared with the third-party providers listed in §11 solely to operate the relevant features. Some of them are located outside your country (including in the USA); transfers rely on those providers' own data-protection mechanisms (such as standard contractual clauses or equivalent safeguards).
- The Administrator does not sell personal data, does not share it for advertising purposes, and shows no ads.
- Data is kept for as long as the account exists; after account deletion it is removed, except for the minimum needed for security or legal obligations (in particular payment records, which the law requires us to keep for 1095 days).
- You have the right to access, rectify, erase, restrict, port, and object to the processing of your data, and to withdraw consent. To exercise these rights, use the contacts in §21. If you are in the EU/EEA you may also complain to the data protection supervisory authority of your country of residence; in Ukraine — to the Parliamentary Commissioner for Human Rights; residents of certain US states have additional rights under their state's law.
16. Intellectual property and infringement complaints
The App, its design and code belong to the Administrator or their licensors. User content belongs to its authors (see §4).
If you believe content in the App infringes your copyright or other rights, or is unlawful, send a notice to [email protected] or use the content complaint form. This works without an account. In your notice, please state:
- the link to the specific content (the page address);
- what exactly is infringing — which rights are affected, or which rule is being broken;
- evidence of your rights: who you are in relation to the material and what your right is based on;
- a contact address for our reply.
We reply within 7 days of receiving the notice. The content may be hidden while the complaint is examined; we inform the author of the complaint and of the decision, and they may appeal it (§12). Knowingly false complaints are not re-examined.
17. Termination
You may delete your account at any time in the «Security» section: the action is confirmed by a code sent to your email and requires no password — so deletion is available to those who sign in with Google or Apple too. Your personal data (pantry, lists, favourites, follows) will be deleted. You choose what happens to the recipes you added at the moment of deletion: leave them in the App without a link to your account (they then remain available to other users), or delete them along with the account — in the latter case the recipes and their photos are gone irreversibly. The Administrator may suspend or terminate your access if you breach these Terms, or if the project shuts down.
18. Changes to these Terms
These Terms may change. The current version is always available at /terms with its
date in the header. Material changes will be announced in the App. Continued use after a change means
you accept the new version.
19. Governing law and disputes
These Terms are governed by the law of Ukraine. This does not deprive you of the protection of mandatory rules of the law of your country of habitual residence (including consumer-protection rules in the EU, the USA or elsewhere). The parties will first attempt to resolve any dispute amicably via the contacts in §21.
20. Miscellaneous
If any provision of these Terms is found invalid or unenforceable, the remaining provisions stay in force, and the invalid one is replaced by a valid provision closest in meaning. The Administrator's failure to enforce a provision is not a waiver of it. These Terms exist in Ukrainian and English; in case of divergence, the Ukrainian version prevails.
21. Contact
Questions, complaints and data requests — via the feedback form or by email at [email protected]. Full seller details, postal address and phone are on the Seller details page.
